1. Mr. Yousri Fakher Mohamed AL-TARIQI, a Tunisian national, was arrested 5 May 2006 in the provice of Salaheddine in northern Iraq by members of the Iraqi security forces. He was either in the hands of the Iraqi security forces, the American military, or the combined forces depending on whether he was in military barracks or unofficial detention centers. In different places of detentions which were unknown to him, he was tortured and forced to confessed to involvement in bomb attacks in Samara, north of Baghdad.
In October 2010 he was "heard" by a judge and openly threatened with death if he recanted statements he made under tortured and been forced to sign. Although he tried to deny all of the charges against him and claim that his statements were made under torture, he was not able to defend himself. On 10 October 2010 he was sentenced to death.
Tunisian authorities had their first contact with him in December 2006 and a second time in April 2008 and had suggested a possible transfer to Tunisia.
On 2 November 2008 he was the object of an appeals case in the course of which he hoped to convince the judge that all charges against him were false and based on statements made under torture and various threats. His attempts were unsuccessful and his death sentence has been confirmed.
The following names were subject to the same cruel, inhuman and degrading treatment and were also condemned to death without having been able to defend themselves in unfair trials. They are as follows:
2. Mr. Badr Ashour Mohamed Ali, a 29-year-old Moroccan national, was arrested in December 2007 and condemned to death in 2008.
3. Mr. Mohamed Fraj FRAJ ALLAH, a 28-year-old Libyan national, was arrested in July 2005 and condemned to death in March 2007.
4. Mr. Adel Omar Mohamed ALI, a 29-year-old Libyan national, was arrested in June 2006 and condemned to death in October of the same year.
5. Mr. Nasser Mubarak MOJIB, a 24-year-old Saudi Arabian national, was arrested in May 2008 and condemned to death in March 2009.
